The editor of Concussion Litigation Reporter, Paul D. Anderson, told LegalNewsline.com yesterday that he expects the NFL concussion litigation to at least make the discovery stage.
Part of Anderson’s rationale was that U.S. District Judge Anita Brody of the Eastern District of Pennsylvania, who is overseeing the multi-district litigation, has shown a propensity for allowing cases to reach that stage.
Anderson told the site that the plaintiffs would likely have to prove that their claims are independent of the collective bargaining agreement (CBA), and that the NFL would probably argue that there is no way to decide this issue without looking at the CBA.
Anderson predicted: “It’s going to be a back and forth battle to persuade Judge Brody that she’s not going to have to look at the CBA and that the claims are independent.”
