The rush to a concussion policy is one thing. Actually getting something passed can sometimes be difficult at best. Concussion policy and the law should always be in everyone’s best interest. Unfortunately, everybody’s agenda is not always the same. That sets the stage for conflict.
In the case of legislation pending in West Virginia’s House and Senate, one senator, also a Boone County doctor, stepped in to challenge the language dealing with who could authorize the return of an athlete to play or practice after he or she suffered a concussion. The doctor was adamant that he wanted immunity for medical professionals from liability. Two lawyers, both specializing in personal injury, objected. And a concussion bill died.
